Odisha Judicial Service Examination

PLAN OF EXAMINATION:

The selection of candidates for recruitment to the cadre of Civil Judges (Junior Division) shall be made through competitive examination, which shall consist of three parts; viz Preliminary Written Examination, Main Written Examination and Interview as per the provisions of the Odisha Superior Judicial Service & Odisha Judicial Service Rules, 2007 (as amended from time to time) and the syllabus as specified below:-

A. Preliminary Examination:

(I) The Preliminary written examination shall be of one paper carrying 100 marks with duration of one and half hours of examination with objective type questions of multiple choice 100 questions of one mark each with negative marks of twenty-five percent for every wrong answer allotted to that particular question on the following subjects and the OMR answer sheets will be scrutinized by Computer.

(a) The Constitution of India

(b) The Code of Civil Procedure, 1908

(d) The Indian Evidence Act, 1872 and The Bharatiya Sakshya Adhiniyam, 2023

(e) The Indian Penal Code, 1860 and The Bharatiya Nyaya Sanhita, 2023

(f) The Limitation Act

(g) The Transfer of Property Act

(h) The Law of Contract

(i) The Law of Succession (Indian Succession Act and Hindu Succession Act)

(j) The Specific Relief Act

(k) The Protection of Women from Domestic Violence Act, 2005, and any other relevant topics in law(s), as the High Court of Orissa may specify from time to time.

N.B.: – The Commission shall call the eligible candidates for Main Written Examination, who have secured not less than 35 (thirty-five) per centum of marks in case of Scheduled Caste and Scheduled Tribe candidates and Persons with Benchmark Disabilities and 40 (forty) per centum of marks in case of others in the Preliminary Written Examination.

B. Main Written Examination:

(II) The main written examination shall be on the following two compulsory papers and three optional papers. Each of the compulsory subjects shall carry 150 marks with a duration of 2 ½ (two and half) hours of examination and each of the optional subjects shall carry 150 marks with a duration of three hours.

(1) Compulsory Papers.

PAPER – 1 General English [150 Marks]

(a) Translation and retranslation of ten lines each

(b) A short Essay of about 150 words

(d) 1 (one) passage of about 500 words with 5 questions

N.B.: – For “Translation and retranslation of ten lines each”, there will be two passages, i.e. one in English to be translated into Odia and another in Odia to be retranslated into English.

PAPER -2 Procedural Laws [150 Marks]

(a) The Code of Criminal Procedure, 1973 and The Bharatiya Nagarik Suraksha Sanhita, 2023

(b) The Code of Civil Procedure, 1908

(2) Optional Papers.

A candidate may choose any of the three subjects among the following:

(i) Law of Crime & Law of Torts: 150 Marks

(ii) Personal Laws: 150 Marks

(a) Hindu Law

(b) Mohammedan Law

(iii) Law of Property: 150 Marks

(a) The Transfer of Property Act, 1882

(b) The Specific Relief Act, 1963.

(iv) Law of Contract: 150 Marks

(a) The Indian Contract Act, 1872

(b) The Sales of Goods Act, 1930

(d) The Negotiable Instrument Act, 1881

v) Jurisprudence and The Constitution of India: 150 Marks

NOTE 1:

(a) A candidate shall answer the papers in English unless otherwise directed.

(b) The standard of papers shall be that of L.L.B. Course and in respect of Compulsory Paper-|, it shall be of a degree course.

(c) The Commission shall call the candidates, from amongst those who have secured not less than 45 (forty-five) per centum of marks in aggregate and a minimum of 33 (thirty three) percentum of marks in each paper in the Main Written Examination, for interview which shall not more than three times the number of advertised vacancy under each category in order of merit. Provided that candidates with Benchmark Disabilities who have secured not less than thirty per cent marks in each paper and a minimum of forty per cent marks in aggregate shall be eligible to be called for the interview in proportion of 1:5.

NOTE 2: The optional subjects for the Main Written Examination, mentioned by the candidate in the online application form, will be treated as final. No request for change of optional subject(s) will be entertained.

C. INTERVIEW: –

(III) Interview shall carry 100 (one hundred) marks. Questions to be asked in the Interview may not ordinarily be outside the syllabus prescribed for the Main Written Examination. In the Interview, questions covering broad national and International issues and matters of common interest in the field of Arts and Science may also be asked.

NOTE 3: The marks secured by the candidates in the Interview shall be added to the marks obtained in the Main Written Examination so as to arrive at the total marks secured by the candidates and the names of the candidates shall be arranged in order of merit on the basis of such total marks.

Provided that the names of the candidates shall not be included in the merit list unless such candidates secure a minimum of forty per-centum (40%) marks in the interview.

The Documents / Testimonials submitted by the candidates will be verified before the Interview with respect to their correctness and authenticity.

The Commission shall prepare a list of candidates in order of merit on the basis of Main Written Examination and Interview, which shall be equal to the number of advertised vacancies;

Provided that, if two or more candidates secure equal marks in the aggregate the order shall be determined in accordance with the marks secured at the Main Written Examination and if the marks secured at the Main Written Examination of the candidates concerned be also equal, then the order shall be decided in accordance with the total marks obtained by them in the LLB Examination and if the marks obtained in the LLB Examination are also equal, the candidate who is older in age shall be placed above the other (younger).

The list recommended by the Commission shall remain valid for a period of one (01) year from the date of its approval by the Government.

NOTE 4: Any details relating to this recruitment like cut-off marks, answer keys, individual marks etc. shall only be declared on the website of the Commission after publication of the final result and select list.
